SNG and Ras Al Khaimah file papers against GGYC venue challenge
[Source: Alinghi] The defending yacht club has filed its opposition brief regarding BMW Oracle's latest legal challenge (the seventh from the American team; this time against the venue). The papers state the absolute legitimacy for Ras Al Khaimah to be the venue as per the Order and Judgement of 7 April 2009 ("[...] the location of the match shall be Valencia or any other location selected by SNG [...]"). The papers also demonstrate the capacity of the Emirate to host the 33rd America’s Cup in terms of infrastructure and security.
In addition to the Société Nautique de Genève papers, the Emirate of Ras Al Khaimah, one of the seven that form the United Arab Emirates, submitted an amicus brief informing the Court of the safety and suitability of Ras Al Khaimah to host the 33rd America's Cup in February 2010. The Emirate was surprised and offended by Golden Gate Yacht Club and BMW Oracle’s statements as there is absolutely no basis for the assertion that RAK is an unsafe or otherwise unfit venue for the America's Cup.

Strangely enough, none of the documents addresses the question whether RAK is a "Deed legal venue". That is hard for me to understand. Why would you not want to cover this base as extensively as possible?

Frankly it seems that Alinghi's lawyers have failed to earn their pay once again.
Good PR by SNG but pity they are breaking more NYSC rules so they might not even have this paperwork entered into court on the day of the hearing. Like the AC SNG needs to understand the rules.

That's because this part of the Deed is overruled by the Court's decision. Coutts and Ehman both accepted that SNG could select any location in the north or south hemisphere.

What I love about this fight between oracle and alinghi, is that all those pro oracle despise alinghi's tactics, but find it normal that the decision involving an american team is made in the US (a great example of impartiality) by a judge which knows nothing about sailing....
