Statement from the Société Nautique de Genève

[Source: Alinghi] Société Nautique de Genève and Alinghi thank Golden Gate Yacht Club and BMW Oracle for their Christmas gift and their wishes for further litigation in the New Year!

"Having disqualified all other Challengers for the 33rd America's Cup through their legal strategy, Larry Ellison's team is now trying to do the same with the Defender and continues to pursue its attempt to win the America's Cup in court rather than on the race course," says Fred Meyer, SNG vice-commodore.

"We fear that this is an attempt by BMW Oracle to avoid racing Alinghi on 8 February," adds Grant Simmer, Alinghi design team coordinator.

BMW Oracle's accusations regarding the defending yacht are simply false: Alinghi 5 complies with the Deed of Gift "constructed in country" requirement, it was built in Switzerland and so are its sails.

Kind of disappointed in SNG/Alinghi's response. Thought they could of been a tad more creative. I guess their resident cartoonist is on holiday break.

The Deed says on page one : "..., with a yacht or vessel propeled by sails only and constructed in the country to which the challenging Club belongs, against any one yacht or vessel constructed in the country of the Club holding the cup."

and the Deed does not say : propeled by a WING .... TE, l'arroseur arrosé ... !!!! Whouaaaaaa

well, if A5 complies with the DoG CIC rules Alinghi has nothing to worry about...and this one will be settled by an international jury of sailing experts - so there will be no reason to complain about the "biased NYC court system" should Alinghi be found to be at fault.

With this defensive, arrogant statement Alinghi have made another stupid mistake. They protest GGYC's letter by saying that their sails ARE built in Switzerland, when they should have said "sails are not required to be built in country." Coutts and Ehman play their cards cleverly, and Alinghi are playing into their hands.

whatever....important is to start the 34th cup asap....rest who cares....
I don't belive that BMWO will be better in case they of victory, so we only need a new multi challanger AC and rest is not relevant anymore....
Hopfully TE shares this view...

Not at all, they've responded to the accusation that the sails are not made in Switzerland by saying that they are. Good on Alinghi for giving this accusation the respect it deserves. Oracle will go down in history as a cancer within the sport of sailing. The sooner their sailing team disbands the better for our sport.

638 PM- all that is being done by GGYC to get SNG to conform to the rules is relevant to the AC & the sport.

650PM - please leave our sport as you haven't a clue about the sport being self regulated nor the AC & courts requirement that the host YC/Trustee separate itself from the Defending sailing team. SNG is the cancer & as the court & sailing experts prove, SNG is being cut out because they constantly think the rules don't apply to them.

Now move along to some other sport if you don't want to adhere to our rules.

You guys should ask yourself if the sails A5 uses for training will be the same as the sails they will use for racing ... remember those black sails they tried during LV 32 ?
Have you any idea who invented 3DL ?
Don't you think they are able to build their own sails ?
I think BOR is in trouble ... nothing new for me.

I think the real issue the GGYC is after is whatever Alinghi is building in the ca. 80m tent covering 3 former bases. Could it be a wing, but not build in country?

Justice Kornreich favours the Merriam-Webster dictionary. In it the defenition of CONSTRUCT is "to make or form by combining or arranging parts or elements". The AC resolutions has CONSTRUCT to mean designed and built. BUILD is defined as " to form by ordering and uniting materials by gradual means into a composite whole". So assembling the sails components in Switzerland woudl comply as CONSTRUCTED in Switzerland by teh dictionary.

Sailmaking is a worldwide effort,is it not, designers and sailmakers worldwide.
Call me ignorant or just a dumb-ass, but wasn't North 3DL invented by a Swiss national- Jean-Pirre Baudet?

3DL patents - they all have been assigned to North Marine or North Sails as the inventors were employee's of North at the time.

Ownership of the patents is under US law & based on what type of employment contract the inventor had with the employer.
