America's Cup legal uncertainty forces AC Management to end Host City contract with Valencia

[Source: America's Cup Management] As a consequence of the continued uncertainty around the 33rd America's Cup caused by the Golden Gate Yacht Club's legal manoeuvres, AC Management and the Spanish institutions (Central State, Valencia Region and Valencia Municipality) have been left with no option but to revise the terms of their relationship, ending the contract signed in July 2007 that named Valencia the Host City for a multi-challenge 33rd America's Cup in 2009.

The two parties have entered into a new agreement that concludes months of discussions trying to adapt the contract signed after the success of the 32nd America's Cup to the current legal context. Under the new agreement, the organisation and exploitation of the Port America's Cup facilities will be managed by the Spanish institutions from 1 July; the 33rd America's Cup teams retain the opportunity to continue using their bases and the majority of administrative benefits for teams and personnel remain in force until the end of 2008.

Michel Hodara, Chief Executive Officer of AC Management, the company organising the 33rd America's Cup on behalf of the defending yacht club, Société Nautique de Genève, explains: "Too many issues, such as the dates and participants, remain unresolved until the Appellate Division of the New York Supreme Court publishes its decision; meaning the July 2007 contract is no longer appropriate. The Spanish authorities understand the situation and we are pleased that we have come to a new agreement adapted to the current context, in the best possible spirit. We thank them for extending the use of the bases and the administrative benefits to the teams.

"This does not mean that we are leaving Valencia. The choice of the venue for the 33rd America's Cup will mainly be based on competitive factors and if Valencia is considered the best place, then a second America's Cup Match will take place here."

The 33 America´s Cup, which is between Oracle and Alinghi in catamarans was never destined for Valencia.
The Swiss just want to take the cup to a port which will pay them more...Granted Chirivela and Pombo thought they were the most important persons in sailing in Spain, their vanity and innocence allowed for Bertarelli to pull the wooll over their ears. Bertarelli knew it all along and thoughtwith thse two guys on board he could do what he wanted... Bertarelli and the Geneva Yacht Club are responsible for this nonsense.
Who loses? All the lovers of sailing and sailing events...
Be careful Rita, you can bring lots of other events to Valencia...

A.C.M. Société Nautique de Genèbe o Ernesto Bertarelli, da igual,
dicen …: Como consecuencia de la continua incertidumbre causada por las maniobras legales del Golden Gate Yacht Club, se ven obligadas a modificar los términos de su relación, poniendo fin al contrato que designa a Valencia como Ciudad Sede de una 33 America’s Cup con múltiples equipos en 2009.
O sea que el “malo de la película” es BMW Oracle y por supuesto su jefe Larry Ellison. Quien haya estado siguiendo los últimos movimientos judiciales acerca de la America´s Cup en los tribunales de N.Y. sabrá de sobra que el único que está poniendo trabas a una pronta celebración de la 33 A.C. en el agua es Ernesto Bertarelli.
Cuando el sindicato californiano presentó una demanda judicial en N.Y. lo único que pretendía era que la 33 A.C. no se celebrase con “las cartas marcadas” como lo había “cocinado” Bertarelli junto con las autoridades valencianas y la federación española de vela. Que habían creado un club ficticio el CLUB NAUTICO ESPAÑOL DE VELA como (Challeger of the record) o sea el el challeger genuino y representante de todos los otros challengers. Único con capacidad para negociar con el defender las condiciones de la próxima A.C. un club sin existencia previa y que su único fin era amañar un protocolo de competición diseñado exclusivamente para que Alingui ganase de nuevo la copa de una forma casi automática.
¿Había o no había que pedir amparo al único tribunal que tiene competencia sobre esta competición? Inicialmente lo hizo Oracle, pero posteriormente se unieron o al menos lo pretendieron, un nutrido grupo de sindicatos.
Si en Valencia no se vuelven a ver regatas de la mas antigua competición en el mundo, no será por aquellos que han pedido ayuda a la justicia, para mantener un poquito de limpieza en esta competición, si no ...... infórmense ustedes y no se dejen engañar.
