BMW Oracle files motion in NY Supreme Court

It seems there is no end to the ongoing legal saga between Alinghi and BMW Oracle. The America's Cup Challenger of Record returned to the NY Supreme Court on Monday by filing a motion seeking to punish SNG/Alinghi for contempt of court.

The exact content of the motion has not been published and we haven't been able to reach any official from BMW Oracle. Still, as most sources speculate, the motion most probably concerns Alinghi's intention to hold the 33rd America's Cup match in May 2010, something going against the court order of holding it, in Valencia or any other venue they might choose, starting February 8th, 2010.

We will have more information as soon as possible.

The Euro-poodles, instead of listening at the judges and plan for February 2010 as they have been ordered, they decide under the suggestion of the best lawyers you can buy, to race in May. If that's not contempt to the court..... But what are these Alinghi people thinking....

Actually, the judge said to "work things out" - he didn't say "come back and see me". And he left the date/hemisphere issue at best ambiguous.

But its always easiest to put the blame on somebody, and go out and fight in (your own) court. Its the American way! Poor people ....

2:08 & 3:25PM - why don't you click on the motion details image on the front page of VS??? If you do & open your eyes, you will see your hero EB is in court 2x as much as GGYC.

It's really EB who's holding things up & using the courts to try & keep his way w/ The Cup.

My dear Norberto, you are still blinded? Allinghi arranged for a 33rd AC with all the teams of the world. BOR arranged for blocking all of that with their frugal court actions.

One question: wouldn't it have been great to have AC competition this year? Followed by the actual AC next year? With a mutually agreed upon protocol?

Well, it was all there .... until Crazy Larry got another hair up his ass!

You are soooo right! And that's exactly what LE is trying to do. He has seen how a well run AC (and a profitable one) should be run during the last AC (the one that his ass got kicked)

The AC will happen again but not until EB/SNG/Alinghi are shackled & The Cup is being respected.

11:22 Anonymous ..... what have you been smoking? I suggest that you yourself read the deed, as you dont seem to understand the rule about setting dates/hemisphere, etc.

Its the challengers responsibility (and NOT some courts) to propose dates. Based on that the hemisphere is determined.

BORs rush back to court clearly shows that they are not interested in any mutual agreement, they are a bunch of warmongers.

And they will never win the AC, you will see!

2:52 PM - understand that like CNEV being ruled on by the courts so will the dates.

The court not only deals w/ the 4 corners of the Deed but also enforces by orders what they deem under trust law to be the best for the Deed.

In this case it means balancing the right of the Challenger vs the rights of the Defender. Ask yourself why the courts put in the order 6 months notice on the venue? It's not in the Deed is it?

He didn't say: Come back and see me again, if you get your underpants into another bind, Larry!

After stonewalling the whole event and after eliminating all the teams for years, LE is now suing (again) over 90 days ....... totally ridiculous!

12:36 AM - count the number of months & it's more like 2 years since the challenge was issued by GGYC.

EB has been in court 2x as much as GGYC so asked yourself who is delaying & not respecting the Deed once again. Oh, but this time SNG is not respecting the NYSC either. Really sad for our sport & the AC.
