ISAF Racing Rules will govern the 33rd America's Cup match

[Source: ISAF] The International Sailing Federation (ISAF), the world governing body of the sport, and the Societe Nautique de Geneve (SNG), the trustee and holder of the America's Cup, are pleased to announce that the 33rd America's Cup Match will be conducted under the Deed of Gift provisions, the SNG rules, the ISAF Racing Rules of Sailing and ISAF Regulations as required by the Deed of Gift.

Any changes to the ISAF Rules and Regulations not already covered by provisions within the ISAF Rules and Regulations will require sanction from ISAF.

The Principal Race Officer, International Jury members and International Umpires (if Appendix C is used), will be suitably qualified personnel and will be independently appointed by ISAF. The process of which has already begun.

The questions is WHICH SNG rules? The 2007 rules (which were in force at the time of the GGYC challenge) that didn't allow for moveable ballast and powered sailing systems, or the 2009 rules which have now been modified so that SNG can do whatever the heck they want whenever the heck they want? Is that what ISAF is proposing to sanction?

Peter,
the ISAF rules have also changed between 2007 and 2010 (ISAF always review and change rules after the olympics).
Please advise if the AC match should be raced under ISAF rules 2004-2008 or 2009-2012.

Dear SNG,

We will hold you to the 2007 SNG Annual Regatta club rules at the time of our challenge.

Like Judge Cahn's order which SNG dragged through the courts for 2 years, your actions are not going to change the order. May we remind you that this order was reconfirmed by the NYSC CoA in a 6-0 verdict.

To date, SNG has yet to affirm what rules you are planning to use even though we have asked. Hence we can not give you a CHR as we are uncertain as to your intentions which makes it impossible for our boat to be designed to whatever those rules you have yet to confirm with us.

Further we remind you that the Deed is the default rules of the match. The Deed also explicitly provides that the defender’s “rules and sailing regulations” for the match may only be modified through mutual consent of the defender and challenger. Also, that the Deed requires that we agree on the start times of the races. That has not been done even though you have a secret agreement with ISAF regarding the match. We remind you that ISAF Appendix J states the race times shall be in the NOR. We have not been contacted so we done not know how you can discuss anything about the match with ISAF regarding rules that are not affirmed or not yet agreed to.

Once again, you proceed with total disregard for the Deed. Further proof that you have forsaken light and truth from when it was first original to you.
