- Transcript of the oral hearing GGYC vs SNG, 21 July 2009

[Source: Golden Gate Yacht Club] We are pleased that the Court will provide clarity on the rules before we complete our challenging vessel for America's Cup 33.

The Court reserved her decision whether an engine and moveable ballast can be used. Justice Kornreich understood that we need to know the rules before we can complete our challenging vessel and then submit our Custom House Registry (CHR).

The Defender was compelled to turn over to the Court the secret agreement with International Sailing Federation (ISAF).

On questioning from the Court, Société Nautique de Genève (SNG) agreed to return to mediation, a process we have supported throughout our challenge.

We look forward to Justice Kornreich's decision in the next few weeks, and to racing for the America's Cup in February 2010.

You know you lost right? Your contempt of court charge was dropped right? Yes they have to turn over the rules, they were going to soon anyway, whats the difference? Can't you just race?

Why ask a judge what can and can't be used, grow some balls and talk to Alinghi if you have an issue, or go cry to your mummy.

Mr Anonymous,

Obviously, Messrs Ellison, Ehman and Coutts are playing this game at a level somewhat advanced for your Simple-Simon understanding. Likewise Mr Bertarelli and his cohort.

7:02 AM - Please read the transcript before you spout off. Also, the Judge will give a decision in 10 days or so on which rules shall be used.

The Deed is governed by the NYSC & not SNG. The only reason things go back to court is SNG is trying to get more time, SNG gamesmanship & SNG BS.

Why just race when there are no rules. No rules no boat can be designed for the race. Btw the whole reason we are here is SNG's creation of CNEV & now 2 years of court because SNG couldn't build a boat in 10 months.

If SNG had some balls they would do what other Defenders had done for hundreds of year & that is putting The Cup & sportsmanship 1st.

Also, don't forget the NYAG is inquiring about SNG & they were in the courtroom yesterday so don't paint SNG as being totally clean.
