SNG statement following the New York Court order of 18 September

[Source: Alinghi] New York Court finds Golden Gate Yacht Club’s behaviour "unsportsmanlike".

In her ruling relating to a hearing on 10 August, New York Supreme Court Justice Shirley Kornreich highlights “…the unsportsmanlike behavior of Golden Gate that has resulted in substantially reducing SNG's (Société Nautique de Genève) advantage as originally contemplated by the Deed of Gift.”

The 33rd America’s Cup Defender, Société Nautique de Genève, had filed an Order to Show Cause in front of Justice Kornreich who, despite such an unprecedented statement describing the actions of GGYC, considers such “actions are not contrary to law” and is left with no option but to deny the motion.

Justice Kornreich’s order also reiterates that the race shall be sailed under the rules and sailing regulations of the SNG.

SNG and its representing team Alinghi remain committed to a 33rd America’s Cup fought on the water in Ras al-Khaimah in February 2010.

February 2010 is near.
I hope that GGYC will concentrate in training on the sea, instead of keep on fghting for the Cup in Courts.
Up to now I've agreed with GGYC strategy, but now all this endless querelle must have a stop.
Let's fight and see who's the best on the water!

So GGYC is the one that is behaving in an unsportsman like manner? So what was SNG/Alinghi trying to pull with the sham that was CNEV? Just a practical joke? Confusing.

Well sportsmanship has been introduced into these proceedings. I wonder how Judge Judy will rule when GGYC points out the fact that SNG/Alinghi put it in the record that they would not use measurement rules to DQ GGYC's boat. Then turned around a week or so later and did just that? Unsportsman like indeed.

It's more a case of Oracle trying to bend the rules so their boat will fit. They said 90x90 and they have enough guys who should know that rudders are commonly accounted for in the majority of multihull regattas. They have enough time to make it fit so it's clearly a case of Oracle biting their nose to spite their face. I fear it will bite them if they don't accede.

Unsportsmanlike? This judge never heard the issue of CNEV and has failed to grasp how underhanded Alinghi has been in changing the rules in secret to include engines and movable ballast and designed them to exclude Oracle. She even thinks a smaller boat is somehow and advantage!!! She perceives Oracle's desperate attempts to modify BOR to include what Alinghi has made legal is somehow underhanded. In matters of law she is qualified, in the history of sailing and America's cup, she is ignorant and has been fooled. Alinghi's public relation team, descendants of Goebbels "Make the lie big, make it simple, keep saying it, and eventually they will believe it".

EB has the cup and intends to keep it no matter how he has to do it. Easy way to solve this problem and the court's inability to see the reality of what the America's Cup is and always has been - let him keep it. No one who truly believes in sportsmanship should ever again sail for the AC, it is dead in EB's greedy hands. Start a new series such as the LV and let the AC rest in pieces.

Wayne. What a load of rubbish. The cup is and always will be the most prestigious award in racing. The LV series will be dropped like a turd the second the cup gets back on line.

That's the point, they've all made a mess of it. So let EB keep it, it's obviously an obsession of his.

Start a new series run fairly by all those who race in it, and that can't be manipulated by ego-centric idiots, who have too much money and time on their hands and no regard for the history of the event.

You can have hi-tech without motors, it's supposed to be about sailing with sailors, not machines, EB never got that!

Where is EB taking The Cup as a event??? Look no further to what EB did to the racing on Lake Geneva. It's a local or maybe Euro event controlled by the locals and that's it.
