Alinghi: GGYC provided misleading information to US Coast Guard and NY Court
[Source: Alinghi] Société Nautique de Genève’s legal counsel has brought recently discovered information concerning Golden Gate Yacht Club’s (GGYC) Certificate of Documentation (COD), previously known as the Custom House Registry, to Justice Kornreich’s attention. The America’s Cup Defender obtained the documents submitted to the US Coast Guard by GGYC to obtain the COD through the Freedom of Information Act and discovered that GGYC had asked for priority treatment as it wanted to ship its boat to the United Arab Emirates on 25 September. It has also been revealed that the Challenger withheld information at the 10 August hearing concerning their COD; the GGYC had obtained a tonnage certificate nearly two months prior to the hearing and didn’t disclose its existence to Justice Kornreich or the SNG in court.

This is where Alinghi need a moment of pause...What is the right thing to do for the future generations of Americas Cup teams and fans?.
Well, well!!! Nothing like true evidence that SNG is trying to win things on the water. Ya right!!!
They are such a laughing stock writing another whinning letter to the Judge. Oh, btw someone should explain to them that writing a NY Judge in this fashion is against NY court rules.
What a shame SNG is as there is nothing they can do about the COD as stated by the current Judge. Sadly this is another example of how unsporting, desperate of a unworthy Trustee they are.
It's only a matter of days BOR will reveal their wing and it's expected it will be only a matter of days after that SNG will write rules to exclude the BOR wing. SNG is a disgrace to the sport and should be stripped of The Cup by the courts and put on probation by ISAF. These are the only things SNG has earned for itself.
Letters from litigants are not accepted by Judge Kornreich’s chambers. If Alinghi's high $ shysters can't follow the correct procedures they should STFU!
One more proof of GGYC badfaith. They will truly look stupid when they will need to race in RAK.

When is Alinghi going to stop beating that dead CHR horse? They got Oracle's CHR months before Oracle were required to provide it. Obviously the SNG lawyers' letter to the judge, which does not even ask for anything, is just another attempt by Ernesto to smear his opponents -- in court and in the court of public opinion. When is he going to grow up?

But I think that no new rules can be made by SNG at this point of the situation.
still, I don't understand all the fuss about the COD. There is virtually no information in it that would help Alinghi in any way to better prepare for the cup.

you guys do not get that tgis letter is not about he COD. It is about the venue.
Why BOR would have announced a departure to UAE if they have no intention to race there?
Because they try to block Alinghi just for the sake of it.
Let's not get things confused. If Alinghi is not all clean, in that case the blame goes fully to BOR.
Why don't they jsut race in RAK. They'll lose anywhere anyway.
Although BMW Oracle opposes the venue it is totally legitimate for them to ship their vessel to RAK. After all, BMW Oracle is entitled to consider the possibility that the court decides that RAK is Deed legal. On the other hand, why ship the boat to RAK, if you have been told already, that your boat will be DSQ for not measuring (although this possibility was specificly excluded by Alinghi's lawyers in court).
I think Alinghi has really nothing in it's hands here. The letter to the court is only an indication of how desperate they are. Justice Kornreich will definitely not be fooled by such actions.

Valencia Sailing do a complete and fair Job of all their reporting; its an excellent site. If you want to complain about the trolls at BYM go there and complain.

I thought that Alinghi trumpeted :
