GGYC files reply brief on motion to invalidate RAK
[Source: BMW Oracle] GGYC has served our reply brief and exhibits on SNG and filed them with the NY Court. Our latest filing is a point by point rebuttal of SNG's opposition papers to our motion asking the Court to invalidate RAK as the venue and return the AC 33 Match venue to Valencia in February, 2010. The hearing on this venue motion, and our motion for fair rules previously briefed (and papers posted below), is Tuesday, October 27, 2009 at 11am, Supreme Court of New York County, 60 Centre St., New York City.

it becomes so ridiculous. rak would violate the deed of gift, but valencia would not (even if it is located in the northern hemisphere)?!
hopefully the court will send bmw/o back on the water and let them loose in rak …
One should remember the purpose of the requirements in the DOG. The rule excluding sailing in winter was designed to avoid dangerous conditions at see. This is certainly not the case of RAK.
As for the security aspects, BOR could ask the US Navy to protect his vessel during the match...
Well, well I understand all your frustration given the fact that this document is excellently written. This one may be difficult to handle for Alinghi. I think it is time the two teams come to an agreement: Alingi does not DSQ BMWOracle for "not measuring" and in return BMWOracle comes to RAK to sail AC33.
It's a bit hard for the Navy to protect an island that will not move for missiles fire from the other shore line.
this is the only and last chance for LE and RC and TE to win the cup.... they are and will stay looooosers for ever.

oh my God - poor us guys - the only want to save the world but unfortunately nobody wants them! YES take he navy and the marins and what ever you have got- but all of that will not help you to win the Cup - it is all about sailing and not a world and terror war!

12:03pm you are definitely either blind or confused if you support SNG who was found in a court of law to be cheating. Since then there has been more evidence to add to the CNEV cheat so the BFD case is going to be that much easier to have SNG dropped as a Trustee. The law of the Trust comes 1st & it something that SNG and people like you just don't get it that it about being fair.
I am amazed the you guys seem to know exactly what the rest of the world wants. I am European and I do not at all agree with you. If it were only about saililng that would be wonderful.
It is a simply as that: E.B. has started this ugly thing - he was not willing to negotiate with BMW Oracle once the courts told him that he was wrong and thats why the teams got kicked out and now we have a mess...well who is to be blamed for it? It was a logical step for BMWOracle to go to court because E.B. didn't leave them any other option!
