Judge: America's Cup match can't take place in Ras Al Khaimah in February

This is preliminary, raw info as we get it from the NY Court. It seems Justice Kornreich has ruled from the bench that the 33rd America's Cup match CANNOT take place next February in Ras Al Khaimah since the venue doesn't comply with the Deed of Gift, in the sense that a race cannot take place in February in the Northern Hemisphere.

As a result, unless the race is postponed until May, this decision leaves Alinghi with the options of either choosing Valencia or any other venue, complying with the Deed of Gift, in the Southern Hemisphere.

Still, Alinghi can, obviously, appeal Justice Kornreich's decision....

I repeat this information is deemed to be correct but not official. Stay tuned for more info.

Sadly SNG loosing on RAK gives more ammo for the BOFD case. Hopefully GGYC will continue with the BOFD & get the AC cleaned up as SNG is a bad trustee. If SNG was a good Trustee they wouldn't be loosing in NYSC.

This isn't about winning on the water as SNG is trying to win off the water before the race but they are being illegal about it. Time to get rid of them once & for all so the AC can move forward.

I'm sure that SNG/Alinghi will feign shock and disgust, but IF Justice Cahn had intended to give SNG the right to unilaterally select a venue anywhere in the world, the order would not have specifically named Valencia (as it is Deed non-compliant for the February timeframe). You can be sure of one thing. It will be a cold day in hell before they select Valencia. Just to spite the courts and GGYC.

Even a small lake on the Moon wouldn't suit Mr E. The only thing he demonstrates very well to the entire world is either you do it with me or I'll sue you!! What a sadness for the AC, sure they don't deserve such unfairness. Alinghi will find, and offer an alternative and I can beat on this one again Mr E will say, hummmm couldn't they find a more secure place!!! Shame on you Larry

SNG has a order in front of them to race this Feb. They will be found in contempt if they say they need more time to find a venue as they have had enough time.

SNG has said they have no backup venue so Valencia is the best place to avoid going back to court to get busted. More important is very time SNG is busted it strengthens GGYC BOFC complaint.

I don't think they can select any venue other than Valencia at this point. They needed to announce the venue 6 months before the race. That has now passed, so there's a very good chance that it will default to Valencia.

Would be Alinghi - would skeeze in an obligation to sail to the race destination, to make Russell, Tom and the cowboy Larry have some good time on water instead in a lounge

it would be about time that alinghi deals with all the issues in a true professional way, and not in a childish way like all along....they should talk to bor and get on with the racing, in valencia.

For any team with aspirations to put together a commercialy funded AC campaign in the future this is not good news.
BMWOR may think they're smart but they have singlehandedly raped the AC of any commercial value.
It's about time everyone with aspirations to compete in the future without a very wealthy backer realised this.

why should there be shame on Mr. E if the court has decided that RAK is not deed legal. I think that means Alinghi was at fault. So at best one could say "shame on Mr. B. for derailing the AC"

Alinghi knew that it was a risky thing to announce RAK without consulting BMWOracle first. They took the risk - and now pay for it. So what. They could have talked and negotiated the venue together with all the other pending issues but opted to "do it their way"

The Deed of Gift rules were clear since the beginning of the AC. In a war nobody is right and nobody is clean 100%. When the cord is pulled to much is bad for all the parties involved. Alinghi is under huge stress and is already packing....even if no destination has been announced yet....it will take 1 week to wrap it up everything at least. BOR is under huge stress too cause they have no idea where the AC33 will take place. The only good thing will be that one Valencia or any place in the South hemisphere will be announced...it should be that one.

Alinghi and BOR are sailing teams...so if Alinghi doesn't win in court it's normal, anywhere for a team means the place where they have their field of work. So, I repeat, Alinghi will win anywhere...GO ALINGHI GO!!!!!!!!!

Well it is not the sailing team that represents Alinghi in court. It is a team of very expensive and professional lawyers hired by Mr. B.

6:24pm The AC has never been about commercial value. The only one who has raped the AC since it became of commercial value has been SNG.

The point SNG doesn't get about the AC is that it's a Trust which has to benefit the challengers & defender NOT just the SNG insiders.

6:55 PM - Alinghi will not sail anywhere as they are restricted by their boats design which so far looks like light, lake like winds & seas conditions. Whether A5 can handle Valencia, Point Loma, Hauraki Gulf, Newport RI or Fremantle is another story.

We will find out SNG intentions & A5's design scope in the next SNG press release about a venue.

Sadly SNG gambled & now has to pay the price. They did this once before with Valencia so they can't really keep trying to brainwash the public with wanting to win on the water as they are not.

Talking about integrity when it comes to BMWOR is rich. Coutts is a hired gun who will go for the biggest buck every time. Ellison wants all his own way and throws his toys out of the pram when he can't have it or loses (which is most of the time in the AC). Ehman is just low life.
If you think these guys care about the integrity of the AC you are probably American and certainly a half wit. Or you may just be misguided.

Comment on the day: It seems the dice were rolled and did not come up boxcars for SNG. Alinghi have shown better prowess at sea in the last 2, but they have back themselves into quite a corner. BOR have more time in the water, and have negated almost all of the defender's inherent advantages.

Well, at least there is some evidence of his integrity, the 32nd AC. Even the most synical regarded it as the best yet and the Teams got a cash payout. The venue was brilliant the racing fantastic and fair and the AC achieved a mantle in Eurpoe it has never enjoyed before. ETNZ got bailed ou by EB and they spat in his face ( well Dalton did). Was any cash distributed after the 31st AC?
Valencia were happy, the fans were happy, I was happy but unfortunately an admitedly succesful jerk who hardly set foot in Spain ( I hear he hates Valencia) hired a couple of jerks and got friendly with the Italian Rascal and here we are. Be interested to see any evidence pointing towards the integrity of LE, RC and te.

10:11 PM The only benchmark we have is the NYSC. Right now on winning motions it's GGYC 8 to SNG 1. That in itself is pretty telling of SNG's efforts in twisting the Deed off the water to their benefit themselves on & off the water.

well if the court tells Alinghi that they are not acting in agreement with the deed, that would somehow suggest that they are doing something wrong. If they are told repeatedly it pretty much smells like a pattern...
