SNG letter to Justice Kornreich regarding latest GGYC lawsuit

[Source: Alinghi] Société Nautique de Genève legal counsel wrote to New York Supreme Court Justice Kornreich on Friday stating the defending yacht club's position on the challenger's latest lawsuit contesting the venue choice on the grounds of safety and suggesting a date for argumentation in October.

Extract from the letter:

[…] Yesterday evening at 11:03pm I received an email indicating that GGYC has filed a motion challenging the propriety of Ras al Khaimah as the venue for the 33rd America’s Cup and requesting the Court to relocate the venue of the America’s Cup from Ras al Khaimah to Valencia, Spain. The principal grounds of the motion appears to be that the venue SNG has chosen is unsafe even though Oracle, whose chairman, Larry Ellison, owns BMW Oracle, sponsors GGYC and financed GGYC’s vessel does substantial business in the UAE and Oracle has an office in the UAE. GGYC’s law firm, Latham & Watkins, also has an office in the UAE. Significantly, Russell Coutts, the skipper of BMW Oracle organizes an annual regatta in Dubai (50km from Ras al Khaimah, UAE) in November. […]

The whole world, in BORs eyes, is a dangerous place - exept San Diego and Valecia. A pretty strang worldview...

SNG trying to twist things again, what a bunch of liers they are getting to be. The GGYC letter main point this time & at least 6 other times has been RAK is not Deed legal. End of story. The security issue is basically a ps or btw.

Move on SNG & show up in court to face the music. Suck it up kids.

I agree with you, mate.
This is the only remarkable point of the GGYC Court appeal.
The rest is just SNG's fog, put there by cunning.

Well, no really, the judge said very clearly: Valencia or other venue according with the DOG. Ras Al-kaima is non of those options.

"Of the six or so decisions that have been handed down from the New York judicial system, only one has gone the way of the hapless Swiss - and that was a majority decision which was overturned 6-0 by the Appeal Court in Albany NY.

That is not a good look. "

SNG is flat out lying....again. I have lived in the UAE for years "the skipper of BMC" does not host a regatta here in November.

Point of fact, many sailing regattas here are abruptly canceled due to the Emirati's who have enough money to spend, saying they want a "clean" ocean to drive their yacht around for a weekend.

well, i might have a email site that says anonymous but my name is jim barnett and i'm in mobile alabama. three of the best weeks of my life was spent in Valencia for the A/C Louis Vuitton Act 13: fleet race. Valencia and the a/c port was tremendous and the people all fantistic. why would any one want to race anywhere else?? even you pros your families enjoyed Valencia. and for your info if you think that an American, Alabama Vietnam war vet is going to the RAK think again. i'm not going to take a chance on my life where people like to blow up American's.
I really really believe that Alinghi doesn't want to race BOR and that EB is a spoiled rich kid. i hope to be in Valencia in Feb with hard earned money i'm saveing to travel once again to see a great sailboat race in the most perfect place for the race. let's get back to the A/C 32 format with lots of venues and then the big race according to the Deed. Thank you Pierre for this great sailing site.

From CIA World Factbook re UAE:
"Political parties/Leaders: none; political parties are not allowed."

"Illicit drugs: the UAE is a drug transshipment point for traffickers given its proximity to Southwest Asian drug-producing countries; the UAE's position as a major financial center makes it vulnerable to money laundering; anti-money-laundering controls improving, but informal banking remains unregulated."
