Statement from Tom Ehman, Golden Gate Yacht Club Spokesman

[Source: BMW Oracle] In its continuing effort to host the 33rd America’s Cup in Ras Al Khaimah, today Société Nautique de Geneve asked the Appellate Division to reverse the October 27 Supreme Court decision which had declared RAK as non-compliant with the governing Deed of Gift.

In recent weeks, SNG has publicly committed to Valencia as the venue, even while attempting to re-instate Ras Al Khaimah via appeal, as well as floating Australia as a possible venue.

Today SNG also requested that, if the Appellate Court does not reinstate RAK in February, the 33rd Match be delayed from February until May 2010. SNG argued that this was to allow it to choose a venue in the Northern Hemisphere that would be Deed- compliant even though both SNG and GGYC had previously agreed to Valencia by mutual consent.

Additionally, SNG asked the Appellate Court to reinstate SNG’s own peculiar measurement method that would include rudders in the crucial Length on Load Water-Line calculation. The effect of this abnormal practice, never before used in the America’s Cup, would be to disqualify GGYC’s yacht. The Supreme Court ruled against SNG’s measurement method last month.

We appreciate the Appellate Court having handled SNG’s appeal on an expedited basis, and we look forward to its decision.

Tom, I thought that mutual consent needed the consent of both parties. That thing that you do alone, has a different name.

GGYC looks like they are quite comfortable that the NYSC AD is going to affirm the lower courts ruling.

Interesting that SNG is now whinning about needing more time. They must be needing more time for their boat once again & maybe have some serious money issues about the shiek letting A5 out of RAK.

So now its Alinghi in the Courts after insisting it was Oracle..ja, ja...Bertarelli si still trying to get his money from Dubai...Nobody can afford to go out there and see the races...too expensive and uncomfortorble for women...Valencia is great, easy going, nice price. good weather...Come on Bertarelli stop fooling around with everyone...

Two main issues for Alinghi.
1) Initially they believed that BOR90 was suffering structural problems and hence Alinghi wanted to speed up the race even accepting Valencia in Feb 2010... issuing the NOR right away etc etc.
Now Alinghi seems realizing that the BOR90 wing is something that works well. Even in 6 knots breeze BOR is on one hull. That is really impressive and difficult to beat. So now the Alinghi rule is "postpone it , postpone it!!!". In fact the only was Alinghi now can beat BOR90 is to have a wing as well. May 2010 will give Alinghi a chance to try a A5 wing. Feb 2010 no way...
2) A5 will leave RAK at a price that will not be cheap. How much? No body knows, but men and equipment are there and will not fly away till the last cent is agreed.

Il y a encore plein de trois décis à boire avant quelque chose quelque part, je suis partant pour une 1ère tournée pour casser du bois sur les Yankee.
