33rd America’s Cup

Dear Commodore,

We are in receipt of your letter of 4 January 2010.

We are pleased to confirm that SNG will issue the Sailing Instructions and amended Notice of Race as announced on 8th January 2010.

The 33rd America’s Cup International Jury was appointed on December 4, 2009. Since then, SNG has signed the indemnity agreement for ISAF and the other officials. There was a small delay in collecting the signatures due to the Christmas break. The independence of the jury has been confirmed as well. The International Jury is now constituted and fully operational. It is ready to deal with any issue related to the 33rd America’s Cup. If you have any question in this respect, please contact Mr. Jerome Pels with ISAF.

In regard to mooring your boat in the Darsena, we do not understand your safety concerns since you repeatedly affirmed in Court that Valencia was the perfect venue and had all infrastructures ready. We note that three months ago in your Court Papers of October 1st, 2009 you stated that Valencia "spent three years investing in and preparing its city and marina to support the 32nd America's Cup and now has a world-class dedicated infrastructure for hosting an America's Cup match".

Please explain what are the security concerns you might have with regard to mooring USA in the Darsena? SNG will be able to moor its defending yacht in the Darsena in full respect of the security of its crew, vessel and other users.

We look forward to meeting with your representatives and discuss these issues on January 12th, 2010.

Yours sincerely,

Fred Meyer, Vice-Commodore and Chairman of America’s Cup Committee
Alec Tournier, General Secretary

RE: Valencia's Infrastructure

Looks to me like Valencia's Infrastructure is more than adequate, given the large compound BMW Oracle have secured and assembled in a matter of days in the outer darsena. I would not say the same for RAK...

Mr Meyer, if you really want to win on the water as you keep repeating over and over, please stop this nonsense and get on with it. Its starting to appear as though you and your team are afraid! If you continue pushing silly issues such as the berthage, there can be no doubt.

Finally the IJ is ready to go & hopefully they will be able to sort out SNG rather than them getting taken to court again by GGYC.

The security rather than safety statement by Freddie is too funny. GGYC said Valencia was ready & didn't specifically state old AC port harbor. Regardless SNG is just being an idiot once again to wind everyone up over something they have no power to exercise.

alinghi still have not realized that the deed does not state many things including-
where the boats are going to be moored or measured.

Quite of funny SNG telling VLC where GGYC/BOR has to moor their boat. Looks like VLC already gave GGYC/BOR approval on their moorage & camps. SNG is just too comical & a failure at being a Trustee. Time for them to be removed from the AC period.

Wy do you write such a bullshit. It is not in the Deed of Gift but in the Notice of Race- and you know that for sure. It's another try to spite Alinghi...

About time BMWOR got on with it instead of objecting to everything, this is not a competitive issue but probably more to with giving some value to VALENCIA. Pretty clear they want more time now either because they have technical issues or TE has realised the gravy train is about to end. Let's hope Alinghi do everything they can to race as planned and end this episde of the Three Stooges.

I think it is important for the public and the promotion to have both machines in the darsena.

What would happen if Mc-Laren in the formula one would not park the cars in the parc-fermé or in the pit-lane? Bernie Ecclestone would dsq them and anybody else!

So i do absolut understand that alinghi wants to have parked both boats in the darsena.

How could BOR safely stabilize or secure their giant wing inside of the Darsena ? Are they goind to dismast the boat every day ? ... to me they gonna be in trouble in case of strong winds or even medium ! How a wrong bet it is.

hey mr. 7:25
you sound flummoxed by your club's
lack of integrity; "win it on the water". . .what was that word you learned from EB? Bullshit?

to the 7:25am anon - and in your expert opinion the notice of race would supercede the deed of gift? yeah, right.

To Norby,

The NOR is a relevant governing document. It does not need to supercede the DOG only not conflict with it.
