SNG statement following New York court decision on the venue for the 33rd America's Cup

[Source: Alinghi] The Appellate Division of the New York Supreme Court today upheld Justice Kornreich's decision of 30 October 2009 that disqualified the America's Cup Defender Société Nautique de Genève's choice of Ras Al Khaimah in the United Arab Emirates as venue for the 33rd America's Cup. The four-judge panel also upheld Kornreich's decision to exclude rudders from the measurement of the load waterline length of the race yacht.

“Once again BMW Oracle's strategy to try to win the America's Cup in court instead of on the water has been successful. For the first time in the history of the America's Cup the Defender has been stripped of its fundamental right to select the venue. Société Nautique de Genève accepts this decision and Alinghi is looking forward to racing for the America's Cup on the water in Valencia, Spain, in February 2010,” said Fred Meyer, SNG vice-commodore.

There is no better place than the US courts to defend us interest in the americas cup. Bor is definitly the best team in the court, lets see their capacity on the water now,after these historic rulings where a challenger could impose the dimension of the boat, the date of the match and the location to the defender for the first time in the AC history

Isn't this also the first time the defender selected a site that was clearly in conflict with the dead of gift?

SNG had half of the world to look for a site... but they choose to ignore the DOG..... They are just getting what they deserve.

Well, how do you interpret "Valencia, or any other location"? Larry's bought this court, that's obvious to anyone, even the most dipshit of americans. A precedent has been set in the 33rd AC, don't get involved in a legal battle with an american team, because you'll fight it in an american court and that court is as bent as two bob note. It makes me long for a cup that has nothing to do with the americans, they're the scum of this planet.

It's obvious that in the context of the decision that "Valencia, or any other location" implies that otherwise it must be compliant with the Deed. I agree with anonymous 10:08 that Bertarelli had half the earth to choose and he tried to game the system (never mind the phoney yacht club). He made the bed and now he has to lay down in it.

11:36 PM - did you read the AD's affirmation of the lower court as it spells out why RAK is not Deed legal & VLC is. It's called a "carving out an exception "

Maybe you should take some time out from your SNG/Alinghi party line of whining & feeling hard done by, by reading & understanding how law works. Only reason SNG has failed in the courts is because of the person who is telling them what the SNG POV has to be.

You forgot to mention that the bent court also gave the challenger the right to enter a yacht that has nothing to the with the one dimensioned in the notice of challenge: The length, the width, the "keel"...

Finally the nightmare comes to an end. Hopefully BWM-Oracle can quickly close the deal over the Alinghi malcontents and we can return to normalcy (and monohulls) for the 34th edition.

8:45 AM - don't get ahead of yourself as the BOFD case is going ahead regardless of who wins the 33rd. It's all about SNG being a self serving host YC of the AC & sailing. SNG is going to get bumped & a if SNG was the holder they will be replaced by a neutral YC to run the AC so we don't have to put up with all this SNG BS again. EB is finished, he's taking SNG & his buddies with him down the drain.

I'd love to know where you hail from so we all can judge how "fair" the legal system is in your neck of the woods.

As a "dipshit" American I see no proof that Uncle Larry bought anything but Russel Coutts (and friends) and an expensive Tri with the bits that go with it.

Having a lot of money might be able to buy you a judge or two in the States, but its pretty near impossible for even Larry Ellison to buy off the 8 that would have had to been bought to win in court. That might fly in Europe, but not in the states. Especially the State of New York where the Governor was recently dispatched after using public money to fornicate with a "Lady of the Night". Journo's in NYC are snooping around for anything "Juicy" on public officials.

As for precedent being set that a Defender can't choose where to defend the Cup? SNG/Alinghi screwed themselves out of that right the moment they put the venue for AC32 out to bid. And in a Deed of Gift, "hostile" Challenge, the Defender can't just defend the Cup anywhere it wants.

Isn't this what the America's Cup is all about? If the Cup was a fair boat race the event would have died a hundred or more years ago. Since 1851 contraversy has been as much part of the Cup as sailing the match itself and that is what caught the imagination of the large public. Right now I just want to be in Valencia to see these boats race. But until that time we will see more legal battles over a string of issues including the origin of material used for construction and so on. These will surely drag on during and after the event and so paralize any initiatives for the 34rd Cup. There use to be "no second", for the forseable future there are just loosers. One thing is sure; The America's Cup itself will outlast them all.
